ABOUT ACAE
The Alabama Council of Association Executives (ACAE) is an individual membership organization consisting of more than 400 professional association management personnel, hotel and motel representatives, convention and visitors bureau representatives and numerous venders and suppliers. Currently, we have 125 separate associations that are represented in ACAE. Our goal is to enhance the professionalism of the association management field. We sponsor regular educational seminars and offer numerous training opportunities for our membership.

You can be the best negotiator in the world, but the bottom line is whether your contract is legally clear, inclusive and enforceable. Understanding hotel contract basics is critical to both planners and suppliers. This session is for novices and pros that need a refresher on the basics. It will cover legal tips every meeting professional must understand to survive in today’s business climate and avoid expensive lawsuits including: contract formation and revision issues; penalties vs. damages and what’s enforceable; the authority issue in contracts; defenses to performing contracts; how to sign contracts correctly; contingency clauses; understanding the elements of attrition and cancellation clauses; the audit clause and more. Participants will analyze real hotel contract clauses and discuss what’s good, what’s bad and what should be changed to be both fair and enforceable.

John Foster, Esq. CHME, an attorney and counsel for Foster, Jensen & Gulley, LLC., will lead this highly requested seminar. He specializes in the legal aspects of meetings & conventions, trade shows and events, and association management. John also has twelve years of experience as a director of sales and marketing for Hyatt Hotels and Resorts, Marriott Hotels and Resorts and Holiday Inns, and he holds the Certified Hospitality Marketing Executive (CHME) designation from Hospitality Sales and Marketing Association International. A founding member of the Academy of Hospitality Industry Attorneys, John will share his inside secrets for negotiating the hotel contract that you want.
